1. The seller

The Artist Press Kit Template is sold by Pien van der Togt, a sole trader established in the Netherlands, trading as PIEN.DESIGN.

2. Price and payment

Prices are shown in euro and exclude VAT. VAT is added at checkout at the rate of the country you are buying from, so the total you are asked to approve before paying is the total you are charged.

Payment is taken once, at checkout, by Stripe, which acts as merchant of record for the sale and accounts for the VAT on it. There is no subscription and no recurring charge.

The price of the product may change at any time. A change never affects a purchase already made.

3. Delivery

This is digital content. Access is granted immediately after payment is confirmed, through a private access page, and the same link is emailed to the address given at checkout.

4. Right of withdrawal

A consumer buying online normally has fourteen days to withdraw from the purchase. Digital content is treated differently when it is delivered straight away.

By ticking the consent box at checkout you expressly ask for the template to be made available to you immediately, and you acknowledge that by doing so you lose your right of withdrawal once access has been granted. That consent is recorded against your order.

This means that once your access link has been issued the purchase is final and is not refundable. Until access has been granted, the fourteen day right still stands.

A product that does not work is a separate matter entirely and is covered by section 6.

5. Licensing

Use of the template is governed by the License Agreement, which is accepted at checkout and which sets out what each licence covers and what is not permitted.

6. If something is wrong

You are entitled to a product that does what it was described as doing. If your access link fails, the template will not open, or something you paid for is missing, contact support with your order number and it will be put right. If it genuinely cannot be put right, you will be refunded.

This is your statutory right of conformity under Dutch and EU consumer law, and nothing in these terms limits it.

7. Liability

The template is a design tool. It is supplied as it is, and no promise is made that it will produce any particular commercial outcome, booking, coverage or result for you or for an artist you represent.

Liability is limited to the amount you paid for your licence, and does not extend to indirect or consequential loss such as lost income, lost opportunities or loss of data.

Nothing in this section limits liability for death or personal injury, for intent or deliberate recklessness, or for anything else that cannot be limited under Dutch law. If you buy as a consumer, your mandatory statutory rights are unaffected.

8. Governing law and disputes

These terms are governed by the law of the Netherlands, and any dispute arising from them will be brought before the competent Dutch courts.

If you buy as a consumer, this does not remove the protection given to you by the mandatory consumer law of the country you live in, nor your right to bring proceedings in the courts there.

A complaint is best raised by email first, and will be taken seriously.
